Update Windows PATH without restarting 

update your PATH variable, and then go into task manager and close all the explorer.exe processes.

Then go to File -> New Task -> explore.exe

That will restart Windows Explorer (and bring back the taskbar) with the new path

This is problem number 2 I'm having with Windows 7, it seems to only appear in folders that are sorted by something like "date created" but it's really annoying.

I think I found something of a workaround but maybe its not entirely what you want. If you open Windows Media Player (without opening a file) and switch to the Now Playing view, hold the ctrl button while resizing the window. Then exit and open a file. On my computer it will pop up at the same size I had just resized it to.
